PLANTMANIA strives as much as possible to deliver healthy plants and verified terrariums that have undergone an adaptation process with us to your homes. Plants and terrariums are constantly changing, and if you follow the maintenance guidelines, they will become a long-lasting decor in your home.

PLANTMANIA cannot guarantee the lifespan of plants and terrariums as they depend on daily care. Plants are living organisms that are constantly changing, so it is normal for them to shed old leaves, for parts to die as new ones grow, and as such, they cannot be perfect.

The conclusion of purchase agreements via the website www.plant-mania.com is regulated in accordance with legal provisions, taking into account, in particular, the principles and provisions of European Union directives. Concluding an agreement via the website www.plant-mania.com constitutes a distance contract.

These General Terms and Conditions of Business represent pre-contractual information and apply to the conclusion of a purchase agreement if the buyer is a consumer, i.e., any natural person who enters into a legal transaction or acts in the market outside of their trade, business, craft, or professional activity, and if the agreement is concluded between a trader and a consumer within an organized system of sales or service provision without the simultaneous physical presence of the trader and the consumer at one location.

Distance communication means are all means that can be used to conclude a distance contract without the simultaneous physical presence of the trader and the consumer, such as the internet and email.

The contract is concluded when the seller accepts the buyer's offer, and everything stated on www.plant-mania.com represents an invitation to make an offer. The seller may terminate the purchase agreement if the buyer does not pay the purchase price and is not obliged to deliver until the purchase price is received, except when the buyer has chosen cash on delivery.

These General Terms and Conditions of Business also include the General Terms and Conditions of Personal Data Protection. The content of the website www.plant-mania.com is available in Croatian. The official language for concluding purchase agreements is Croatian.

1. BASIC SELLER INFORMATION

The consumer, as a buyer, enters into a purchase agreement with VELES TRANSPORT D.O.O. as the seller. Legal entities as buyers are subject to the application of the Act on Obligatory Relations and the Act on Electronic Commerce, and the Consumer Protection Act does not apply to them.

2. PLATFORM AND INFRASTRUCTURE

PLANTMANIA web-shop is powered by the Shopify platform (Shopify Inc., 150 Elgin Street, Ottawa, Ontario, K2P 1L4, Canada). All buying and selling occurs directly with PLANTMANIA. Shopify is not responsible for any aspect of the transaction between the buyer and PLANTMANIA.

3. MAIN PRODUCT FEATURES

The buyer gets acquainted with the main features of the product on the website www.plant-mania.com. PLANTMANIA reserves the right to change information, including prices and promotional offers, without prior notice. Next to the product image, there is a description of its main features and the price including VAT.

Identification and Declaration of Plant Material

The seller makes reasonable efforts to ensure all plants are correctly declared according to information provided by the producer or supplier. As most plants are supplied in a vegetative growth phase, without open flowers or other morphological characteristics, differences may occur between expected and actual plant characteristics (e.g., flower color, shape, growth height).

The declaration of variety and other plant properties is based exclusively on data obtained from the supplier, and the seller assumes no responsibility for potential differences that become visible only after the plant's development, provided the sale was made in good faith. The buyer accepts this possibility of deviation as an integral part of the purchase agreement for plant material.

Note on Plant Identification

All plants in our offer are supplied in the condition they are in at the time of sale, and many of them (especially flowering plants) may be in a non-flowering phase at the time of delivery. The species, name, and color of the plant are based solely on the declaration and labeling of the manufacturer/supplier available at the time of goods receipt. The seller cannot assume responsibility for potential differences in the final appearance of the plant that become visible only after flowering, provided that all information about the plant is stated in good faith and in accordance with available supplier data.

The declaration of variety and other plant characteristics is based exclusively on data received from the supplier, and the seller assumes no responsibility for potential differences that become visible only after the plant's development, provided that the sale was made in good faith and in accordance with available information.

The buyer accepts this possibility of deviation as an integral part of the purchase agreement for plant material and waives the right to complaint, return, or compensation in such cases, unless gross negligence or intentional fraud by the seller is proven.

Product Availability, Replacement, and Removal from Order

Should Plantmania be unable to deliver any of the ordered products for any reason, a Plantmania employee will contact the buyer by phone or email to arrange for the delivery of a replacement product or the possible cancellation of the ordered product.

Plantmania reserves the right, at its sole discretion and without prior notice to the buyer, to remove a specific product from an order if it is not in stock at the time of order processing, is not suitable for delivery, or does not meet the quality and safety standards for shipping applied by Plantmania.

If payment has already been made for the removed product, the buyer will receive a refund via the same payment method used for the original payment. In case of cash on delivery, the value of the removed product will be deducted from the total order amount.

Plantmania also reserves the right to replace an ordered product with another product of the same or comparable type, quality, value, and purpose, if the originally ordered product is unavailable and a suitable replacement exists.

4. CONTRACT CONCLUSION PROCEDURE

Purchases are made on the website www.plant-mania.com by filling out the provided form. The contract is concluded at the moment the seller accepts the buyer's offer. Purchases can be made 24 hours a day, 7 days a week.

The purchase cannot proceed without indicating agreement with the Terms of Use. By clicking on "Checkout," the buyer places the order and will receive an order confirmation with its number to their email address.

If PLANTMANIA is unable to deliver the ordered product for any reason, the buyer will be contacted by phone or email to arrange for the delivery of a replacement product or cancellation of the order. In case of an obvious error in the price, availability, or product description due to a technical error, the seller reserves the right to cancel the order.

The purchase of products and/or services on behalf and for the account of minors or persons deprived of legal capacity can only be requested by their legal representatives. The purchase is made by ordering available products selected by the buyer based on photographs and basic descriptions. Photographs are illustrative and may not always correspond in all details to the available products.

The purchase is made in a few simple steps from the comfort of the buyer's home, from anywhere in the world. Product search is possible according to various criteria. Entering a specific term in "Search" will display products related to the entered term.

Product ordering is done electronically. By clicking "Add to Cart," the selected product is added to the cart. Placing a product in the cart does not reserve, order, or purchase the product. The buyer can continue to add products by clicking "Continue Shopping" or view the cart by clicking "Open Cart." The purchase cannot proceed without checking the boxes "I agree to the Terms of Use" and "I am aware that the order entails a payment obligation." After the buyer places an order by clicking "Payment," the seller will send the General Terms and Conditions of Business along with the order confirmation to the buyer's email address.

The seller will send the buyer a confirmation of the concluded purchase agreement along with a confirmation that the package has been sent to their email address.

If the buyer does not receive the ordered products they paid for within 20 working days (Saturdays, Sundays, and non-working days excluded) from the payment date, they are obliged to inform Plantmania at the email address plantmania.hr@gmail.com.

If the buyer has not received a purchase confirmation via email within 72 hours, they are obliged to contact the seller at the email address plantmania.hr@gmail.com on any working day.

Should Plantmania be unable to deliver any of the ordered products for any reason, a Plantmania employee will contact the buyer by phone or email to arrange for a replacement or cancellation.

In case of problems or ambiguities during the ordering process, the buyer can contact Plantmania at the email address plantmania.hr@gmail.com on working days.

Wholesale (B2B) Customers

Legal entities as buyers are subject to the Act on Obligatory Relations and the Act on Electronic Commerce, and the Consumer Protection Act does not apply to them. These General Terms and Conditions of Business apply to legal entities in the part related to: price and payment method, main product characteristics, contract conclusion procedure, description of delivery method and delivery costs, general information, disclaimer, and the moment of contract conclusion.

The seller may, at its own discretion, grant a legal entity in each specific case the rights held by a buyer who is a consumer. A user is a person who uses the website www.plant-mania.com, as well as any buyer and visitor of the website www.plant-mania.com.

Verified wholesale and business customers operating under a wholesale agreement with PLANTMANIA are exempt from the terms of personal/household use specified in these Terms. 5. PRICES AND PAYMENT METHODS

All prices are expressed in euros (EUR) and include VAT. The buyer undertakes to pay for the ordered products by one of the following methods:

• Bank transfer to IBAN: HR2223600001103229765 — Zagrebačka banka d.d.
• Cash on personal collection
• Cards on personal collection
• Online card payment via Revolut Business Payment Gateway (Visa, Mastercard, Maestro, Revolut cards and other cards with 3D Secure support), Shopify Payments Gateway, Apple Pay and Google Pay
• Cash on delivery (cash or card, depending on the courier service)

Card Payment Security

Payment is processed via Revolut Business Payment Gateway. Data transfer occurs via SSL encryption. Revolut is a licensed financial institution in the EU and applies PCI-DSS standards. PLANTMANIA never collects or stores card numbers or security codes at any time.

6. DELIVERY

We send plants and terrariums exclusively on Mondays, Tuesdays, and Wednesdays, and sometimes Thursdays (working days) to avoid long waiting times in the package handover chain and ensure fast delivery. In case of unfavorable weather conditions, we will notify the buyer and subsequently arrange delivery.

The order will be dispatched to the delivery service within 7 business days of payment receipt. Delivery within Croatia is carried out within 2 to 10 business days from handover to the courier. All delivery services are performed by GLS courier service.

We currently deliver to the Republic of Croatia and parts of the European Union via GLS courier services. Products that are perishable goods sent by courier service are packaged and secured for transport, but we cannot guarantee that they will arrive in perfect condition, and you assume responsibility for the same. In case of damage to the box and/or its contents, it is necessary to subsequently contact the selected courier service.

Delivery Costs

Customers are obliged to pick up and inspect the shipment in front of the delivery person to avoid subsequent complaints due to damage during delivery. If the customer does not pick up the shipment and it is returned to the seller, the seller will not repeat the delivery without prior arrangement.

7. RETURN AND COMPLAINT CONDITIONS

Return of Perishable Goods (Live Plants and Terrariums)

In accordance with Article 86 of the Consumer Protection Act (NN 19/22, 59/23), the consumer does not have the right to unilaterally terminate a distance contract when it concerns goods that are perishable or have a short expiry date.

Live plants, plant arrangements, terrariums with plants, and other live goods are not subject to return or exchange based on the right to unilateral termination of the contract within 14 days, except in cases where the product:

• arrives damaged,
• has a material defect, or
• does not conform to the order.

We reserve the right to refuse a complaint if we determine that the damage was caused by improper handling, inadequate placement after delivery, or lack of basic plant care.

Complaint for Faulty or Wrong Goods

If the product is damaged, faulty, or does not match the order, you have the right to make a complaint in accordance with the Consumer Protection Act and the Act on Obligatory Relations (NN 35/05, 41/08, 125/11, 78/15, 29/18, 126/21). Contact us within 48 hours of receiving the shipment with the order number, a description of the problem, and photos of the product and packaging.

Upon an approved complaint, we will replace the product, issue a refund, or offer other appropriate compensation. All return costs for faulty or wrong goods are borne by the seller.

Right of Withdrawal — Distance Contracts

For non-perishable goods, the buyer has the right to withdraw from the contract within 14 days of receiving the goods, without stating a reason, in accordance with EU Directive 2011/83/EU and the Croatian Consumer Protection Act.

To exercise this right, the buyer must notify Plantmania of their decision to withdraw by sending a clear statement to plantmania.hr@gmail.com before the 14-day period expires. The buyer must then return the goods within 14 days of notification. The buyer bears the cost of return shipping.

Upon receipt of the returned goods, Plantmania will only refund the price of the product. Shipping costs are not refunded. The refund will be made using the same payment method the buyer used for the original payment.

The right of withdrawal does not apply to:

• perishable goods (live plants, terrariums),
• goods made to the consumer's specifications,
• sealed goods that have been opened after delivery and are not suitable for return due to health protection or hygiene reasons.

8. INTELLECTUAL PROPERTY

All services, including trademarks, texts, images, graphics, video and audio content, and website design, are the property of PLANTMANIA and are protected by EU and international intellectual property laws. These Terms permit the use of services solely for personal, non-commercial purposes. Reproduction, distribution, or modification of content without prior written consent from PLANTMANIA is prohibited.

The content of the website is protected by copyright. Modification, lending, selling, or distributing content is possible only with prior written permission from Plantmania.

9. PRIVACY POLICY AND COOKIES

12. CHANGES TO THE TERMS OF USE

PLANTMANIA reserves the right to amend or supplement these Terms of Use at any time. Changes become effective on the date of their publication on the website www.plant-mania.com. Customers will be informed of significant changes via email or a notice on the webshop. Continued use of the website after the publication of changes is considered acceptance of the new Terms.
